1. Scope

These General Terms and Conditions (“GTC”) of Xperience Metrics apply to all business relationships of customers with Xperience Metrics (hereinafter “Xperience Metrics”).

Xperience Metrics provides consulting and data-driven customer experience (CX) and user experience (UX) solutions to businesses, including tailored strategies, analytics, and digital transformation guidance. Xperience Metrics owns and operates, among others, the website www.xperiencemetrics.com

A customer is any natural person or legal entity that has a business relationship with Xperience Metrics.

These GTC apply exclusively. Conflicting, supplementary, or deviating terms and conditions require the express written confirmation of Xperience Metrics to be valid.

By using services or purchasing products from Xperience Metrics (hereinafter referred to as “Services”), the Customer confirms full acceptance of these GTC.

2. Information on www.xperiencemetrics.com

Xperiencemetrics.com contains information about services. Prices and other details are subject to change without notice. All information on xperiencemetrics.com (service descriptions, images, videos, and other content) is for general information purposes only and does not constitute a guarantee or warranty unless explicitly stated otherwise.

Xperience Metrics strives to ensure that all information provided is accurate, complete, up-to-date, and clearly presented. However, no explicit or implicit guarantees can be made regarding the correctness, completeness, or reliability of the information on this website.

Xperience Metrics cannot guarantee that all listed services and/or products are available at all times. Therefore, all information regarding services and products is provided without warranty and may be updated or changed at any time without prior notice.

There is no general right to access the website. Xperience Metrics reserves the right to modify, restrict, or discontinue any services or access at any time and without notice.

Passwords and access codes assigned to customers must be kept confidential and not disclosed to third parties. In case of misuse or violation of these GTC, Xperience Metrics is entitled to deactivate passwords and access codes at any time without notice and without obligation to pay compensation.

3. Offers and Conclusion of Contracts

The contract is concluded when a customer formally accepts an offer from Xperience Metrics, either in writing or by using the services provided.

If, after the conclusion of a contract, it becomes apparent that the service cannot be provided in full, Xperience Metrics reserves the right to withdraw from part or all of the contract. Payments already made will be refunded where applicable, and no further compensation will be owed.

4. Prices

Unless otherwise quoted, all prices are in Swiss Francs (CHF). Xperience Metrics is not subject to VAT unless explicitly stated.

If consulting and service orders are billed based on time, the applicable fee rate will be determined by the offer valid at the time of order confirmation.

Additional costs such as travel expenses, accommodation, and documentation may be charged separately unless otherwise agreed.

5. Payment

Payments must be made on time for services to be rendered. Online products or digital reports will be provided only after payment has been received.

If a customer fails to pay an invoice within the specified period, they will be in default and may incur reminder fees (CHF 50 for the first reminder, CHF 100 for the second) as well as statutory interest (5% per annum).

Xperience Metrics reserves the right to demand advance payments or suspend services in case of non-payment.

Offsetting claims against invoiced amounts is not permitted.

6. Duties of Xperience Metrics

Xperience Metrics will provide consulting, digital reports, and CX/UX services as per the agreed scope.

Subsequent change requests may be accommodated if feasible, but additional costs and time adjustments may apply.

Xperience Metrics is entitled to engage third parties to fulfill its contractual duties.

If unforeseen circumstances (e.g., force majeure) prevent service delivery, Xperience Metrics reserves the right to cancel or reschedule services. Any payments made in such cases will be refunded, with no further claims for compensation.

7. Obligations of the Customer

Customers must provide timely and accurate information necessary for service execution, including access to relevant systems, documentation, or personnel.

Customers must ensure the availability of the necessary infrastructure, including internet access, to utilize digital services.

Unauthorized sharing of Xperience Metrics content, digital reports, or strategy documents is prohibited.

Customers must attend scheduled meetings or provide timely notice of cancellations.

8. Third-Party Content

Xperience Metrics may include references or links to third-party websites. Xperience Metrics assumes no responsibility for third-party content and cannot be held liable for it.

9. Revocation

Customers have a right to revoke a contract within 14 days of signing, provided services have not yet been delivered. Refunds, if applicable, will be processed within 14 days.

10. Warranty

Xperience Metrics provides consulting and analytics services based on expertise but does not guarantee specific business outcomes.

Availability of online services cannot be guaranteed at all times.

11. Liability

Xperience Metrics excludes any liability to the fullest extent permitted by law. This includes indirect damages, consequential losses, lost profits, or third-party claims.

Customers acknowledge that Xperience Metrics does not provide legal, medical, or financial advice and should consult professionals for such matters.

12. Intellectual Property Rights

All content, reports, and materials provided by Xperience Metrics remain the intellectual property of Xperience Metrics.

Customers may not alter, distribute, or reuse any materials without explicit permission.

13. Confidentiality

Xperience Metrics will maintain confidentiality regarding all customer information obtained in the course of service delivery.

Customers are also required to maintain confidentiality regarding proprietary methods, reports, and other materials shared by Xperience Metrics.

14. Additional Provisions

Xperience Metrics may transfer rights and obligations under contracts to third parties.

Should any provision of these GTC be found invalid, the remaining provisions shall remain in force.

Swiss law applies, and the exclusive place of jurisdiction is Zurich.
